This provision is the reason why in the UK there are so many ancestral estates still owned by the family. On the Continent, under the Code Napoléon, siblings have a fair and equal share in an inheritance and this often means the sale of the ancestral estate when the eldest brother can not "pay out" the other heirs. That is why on the Continent many estatea are placed into the ownership of a legal entity, like a family foundation. A non-natural legal person can not die and is therefore not subjected to inheritance laws and succession taxes.

I'm surprised this is even an issue.
It seems automatic in the nobility.

After all, Charles himself inherited the estate and he was the youngest child.

The title passes to his son automatically but unless the estate is entailed I believe it can be left to someone other than the heir.

I’m not an expert so someone with greater knowledge can maybe explain it better

Charles Spencer inherited Althorp and his title because he is the *only* son of his father. As far as I know, Kitty Spencer, being female, couldn't inherit unless there was a special remainder attached allowing for this to happen and as far as I know, the Spencer estate and title does not have this nor has equal primogeniture passed for the peerage.

So this actually is a non-story. Surprised? Not me. :D

The Earl himself refers to it as a "selection", indicating that at least in this case, it is his own choice to leave the estate to his eldest son and heir to his earldom.

'Is it any fairer that the eldest child gets it instead of the eldest male?,' he asked, reasoning: 'Whatever you say is a selection.'​


Such a stupid and uninformed article.

This is poorly researched and written.

The article confuses primogeniture with male primogeniture indeed, but unfortunately, that is a widespread mistake even among the well-informed.


Why the outrage when even Lord Spencer himself says that "it's no 'fairer' to make a choice based on age rather than gender".

What the article quotes the Earl as saying is "Is it any fairer that the eldest child gets it instead of the eldest male?". As either selection would be equally based on "age" (in reality it is the order of birth, as his son will inherit ahead of any older male relatives in the extended family), his claim is that it is "fair" to put males ahead of females.

Nevertheless, there appears to be no outrage. The government refuses to allow women and girls to inherit titles, knowing that a commitment to keeping the estate for the heir to the title is sufficient reason for many peers to leave their estates to a male.


And doubtful he would do it through the DM anyway.

The Sun posted an article with a headline along the lines of "passing down to THE SON instead of Lady Kitty" in their usual dramatic manner, so I presume this is just indeed a way to garner some "exciting" news about the family.
 
It sure is. It's another way to entice readers and fans to be questioning everything.

Now that's a really impressive Christmas tree at Althorp House,there was some skillful work involved!

It's beautiful...and no mention of Lady Kitty for a change. I love it!!?
 
I don't particularly follow Diana's niece let alone know she was dating Michael Lewis who's almost twice her age.
