Marius Borg Høiby News & Current Events Part 1: December 2023 -

If you have answers, please help by responding to the unanswered posts.
However, Marius has not yet been convicted of a crime and therefore is legally presumed innocent. What (official) rationale could the Ministry of Foreign Affairs and Royal House have used to strip the diplomatic passport from Marius alone without removing Maud's and Leah's?

One rationale could be that Maud and Leah are in the line of succession (5th and 6th). To be honest, it seems strange to me that Marius (from when he became an adult and they announced that his life would be private) had a diplomatic passport in the first place. He has had no royal role at all. And while I don't think Maud and Leah need a diplomatic passport, since they are not doing royal work, they at least have a royal position through the line of succession. That's for the Ministry of Foreign Affairs.

The monarch can strip privileges from a family member for bad & inappropriate behaviour alone, no criminal conviction needed. Even the drug taking could have been enough for that in my opinion, to say we don't want you to use a royal privilege (in this case the diplomatic passport) to potentially transport them, so therefore it will be taken away. The monarch can take all kinds of privileges away from family members if they behave badly...

A diplomatic passport is a privilege, not a right. Being under investigation and indeed charged with a considerable string of serious crimes should be enough to strip Marius of his passport.
Of consideration to the public sense of justice. (Is used frequently in DK in regards to keeping people in jail pending investigation.)
In the interest and reputation of the NRF.
- Plenty of reasons to strip him of a diplomatic passport.

Most people probably agree that the family should take care of Marius and not leave him alone. However, the way he does this is viewed critically, e.g., this joint vacation in Portugal.
The argument that Marius should be prevented from committing any criminal acts at this time by taking him on a holiday, does not really apply. If that were the case, he would have to be “monitored” around the clock by Haakon and the family.
That has not been the case so far, as evidenced by the vacations in Cannes, Denmark, Italy, and Norwegian mountain cabins. All of these trips took place after it became known that he was facing numerous charges of violence and other offenses.
Perhaps they took the vacation to prepare him mentally for the upcoming charges, but that could have been done at home in Norway, away from the public eye. As crown prince, Haakon should be aware of the negative impact this behavior has on the outside world.
It's so completely this. Look at the comment section of the article. Even if we can grudgingly give his family the benefit of the doubt that their intention was "good" now or in the the past (to get treatment/prepare for trial/get him away from bad influences)--*how* they have done it simply looks "bad." Surely they are somewhat media literate? Are they really this blind to how things are being perceived, or is it not something they even care to consider?

Thank you for the responses regarding the diplomatic passport. People have made thoughtful points and I agree.

However, I do not think it is unfair or unreasonable to strip Maud Angelica and Leah Isadora Behn (and their sister Emma next year) of their diplomatic passports along with Marius Borg Høiby. If anything, it may indicate that the Ministry of Foreign Affairs and Royal House have learned a lesson and are attempting to be proactive.

Hopefully, there are not as many red flags in the Behn sisters’ lives (I haven’t been following their social media), but at minimum, they are close relatives of the royal family who have no official responsibilities yet choose to live high-visibility lives as celebrities and influencers. It would not be at all surprising if at some point, people began criticizing the Behns’ access to diplomatic passports, either because of some controversy or simply because the public does not understand what a couple of reality television stars have done to deserve diplomatic privileges.

Revoking the diplomatic passports that are not really needed before it reaches that point seems like a sensible result of reexamining royal passport policies after the Marius scandal, as @kalnel suggested.

Nora Haukland disagrees with the police
Nettavisen: The police believed that it wasn't possible to prove and to convict Marius for mistreatment of Nora. They therefore believed that he should be punished under far milder provision of bodily harm at their recommendation to the state prosecutor. There were doubts, but they decided that this doubt had to benefit Marius.
Bodily harm is the mildest form of violence. The police believe they can prove that Marius has committed two separate cases of bodily harm against Nora and that he has destroyed objects she owns.
Through her lawyer John Christian Elden, Nora sent a letter to the state prosecutor in which she expressed her views on the disagreement. (..)

Information to VG: Marius is being charged with several matters
State Prosecutor Sturla Henriksbø has decided in the criminal case against Marius.
At 14.30 Henriksbø will brief the press on whether charges have been brought against Marius – and if so, what the charges include.
According to VG's information, Marius will be charged with several matters.

John Christian Elden and Heidi Reisvang are the legal counsels for Nora Haukland and two other victims. They have called a press conference at 15.30.

Information to VG: Received 20 000 from the Crown Prince couple - spent the money on drugs
Marius reportedly told the police that while he was with Nora Haukland, he received NOK 20 000 in pocket money from Mette-Marit and Haakon.
The money was intended to cover rent and other expenses, Marius has explained. But instead, it was Nora Haukland who paid for the apartment, while the money he received from the crown prince couple was allegedly used for drugs.
– We still do not comment on the ongoing investigation, writes Marius' lawyer Petar Sekulic in an email to VG.

TV2 published a summary of what has happened some days ago:

So the day has finally come.
To quote the late, great Ms Bette Davis:- "Fasten your seatbelts. It's going to be a bumpy night".

Live:

There are a total of 32 charges!
This includes 4 rapes, described with the word "sovevoldtekt" (term used to describe sexual acts with someone who is asleep or so intoxicated that they cannot give valid consent), abuse in close relationships against Nora Haukland and several acts of violence and breaking the restraining order against the Frogner woman. The four rapes are said to have occurred between 2018 and November 2024. One of the cases is said to have occurred in Skaugum. Marius is also accused of filming the genitals of a number of women without their knowledge or consent and of making death threats, assaulting a public official and violating the Road Traffic Act.
– This case is very serious. Rape and violence in close relationships are very serious acts that can leave lasting traces and destroy lives. The maximum penalty for the circumstances discussed in the indictment is imprisonment for up to ten years. The investigation has included several hundred thousand media files and tens of thousands of messages, says Sturla Henriksbø.
Henriksbø estimates that the trial against Marius could begin in mid-January, and that it will take around six weeks to complete.

Quite a birthday present to Mette-Marit, her birthday is tomorrow.

This is what Høiby was charged with when police prosecutor Andreas Kruszewski sent the case over to the state attorney general :

This is what Høiby has been charged with.

  • One case of rape with intercourse.
  • Two cases of rape without intercourse.
  • Four cases of sexually offensive behavior.
  • One case of abuse in close relationships.
  • Two cases of bodily harm.
  • One case of malicious damage.
  • One case of threats.
  • Five violations of restraining order.
  • One case of molestation by a police officer.
  • Five road traffic offences.

So, if I am understanding correctly, the police only recommended 23 charges but the state prosecutor chose to pursue 32 charges? Is that normal?

Also interesting is how state prosecutor Sturla Henriksbø refers to Marius Borg Høiby as a member of the royal family, despite King Harald V officially eliminating the "royal family" classification last year. Quoting NRK:

"That Marius Borg Høiby is a member of the royal family obviously should not cause him to be treated more leniently or harshly than if corresponding actions were committed by someone else," says Henriksbø.

– This case is very serious. Rape and violence in close relationships are very serious acts that can leave lasting traces and destroy lives. The maximum penalty for the circumstances discussed in the indictment is imprisonment for up to ten years. [...] says Sturla Henriksbø.

What would be the most likely penalty given a maximum penalty of ten years? In any case, it seems there is a realistic possibility that Marius will remain in prison after the trial for the rest of Harald V's reign, but also a realistic possibility that he will not.

Quite a birthday present to Mette-Marit, her birthday is tomorrow.

Interesting. I wonder if the prosecutor's office remembered or took that into account.

Yes, that's true. And the State Prosecutor also changed the charges regarding Nora Haukland to a more serious charge.

The State prosecutor about the violence and abuse of former partners:
An indictment has been issued against Høiby for abuse in close relationships against Nora Haukland. The basis for the indictment states the following "During the period from the summer of 2022 to the fall of 2023 in Oslo/Asker/Alta/Barbados and/or other places, he abused his then partner Nora Haukland through repeated violence, threatening behavior and other offenses. The violence consisted, among other things, of him repeatedly hitting her in the face, including with a clenched fist, choking her, kicking her and grabbing her hard. On individual occasions, he slammed a door in her face, slammed her hands into a wall and pushed her into a refrigerator. Høiby also allegedly threw objects at her, destroyed furniture by smashing cell phones and closet doors, and subjected her to repeated verbal abuse. He also allegedly monitored her whereabouts, who she spent time with, and what jobs she took.
In the case of the "Frogner woman", charges have been brought for individual incidents, rather than a charge of domestic violence. These incidents include: Two separate incidents of violence that included repeated strangulations, blows with the flat of the hand, and spitting in her face. Vandalizing her home, breaking objects, and disturbing her peace by contacting her several times after the relationship ended. A number of restraining order violations. Filming and taking pictures of her genitals without her consent.

Bile rose in my throat! It's been officially confirmed that Marius is a disgusting monster!🤮

Now that we have official charges against him there is no way Haakon and Mette-Marit can feign ignorance or partiality. He needs to be kept far away from the Royal family publicly and their dealings with him need to private and limited. If Mette-Marit refuses to comply and continues to actively support her son financially and publicly she needs to retire from public life!

Taking pics of women's genitals without their consent!? I'm sooo disgusted! I hope he is locked and put away for a very long time!

No error. The State Prosecutor will have the final say and what charges will be brought against Marius.
I too thought it was clear, but perhaps it was a draft submitted for final approval?
If the case or cases go to trial is going to be a media circus. Anyone knows if the local press hints they should settle the case with all known victims out of court?

NRK contacted the Norwegian Royal House for comment. The Royal House said:
"It is up to the courts to review this case and make a decision. We have nothing further to add".

Finally! I am delighted to read this. I hope the trial is well prepared and we don't see any unpleasant surprises along the way.
I hope M gets what he deserves, according to the law.
It would feel right for him doing time in the joint instead of getting probation.
I wonder how this will pan out, will he arrive every day in full media glare with his lawyers, then sit in the dock with a jury or audience? Does Norway have juries?

I feel I should clarify. Rape with intercourse = vaginal penetration. Without intercourse = all other forms of sex.
Abuse in a close relationship is considered serious in Norway! -
One of the rapes took place in the autumn, after Marius was already investigation - for among other things, drug-rape.
So, if I am understanding correctly, the police only recommended 23 charges but the state prosecutor chose to pursue 32 charges? Is that normal?
That is not normal. - Normally they reduce the charges to those they feel that will result in a conviction. I can't off hand recall a case where the number of charges have been increased. That may well be viewed as extra damning for Marius. (I certainly hope so!)
If the case or cases go to trial is going to be a media circus. Anyone knows if the local press hints they should settle the case with all known victims out of court?
Not in a criminal court. - In a civil court, yes. But in this case no settlement.

--------------

It seems to me that Marius is in serious trouble!
And by extension the NRF is in trouble. - Because now it's a trial, a juicy one at that! The press, including the international press, will have the time of their lives!
If it's true that the CP-Couple gave Marius 20.000 NRK = 1.679 € only for him to blow it all on drugs, that will be damning as well. Because the obvious question is: How much more money have they spend on Marius? Lots of questions and they can't keep silent forever. At some point at least Haakon has to come out and give a detailed account of the NRF and Marius and how they dealt with him and intend to deal with him in the future.
The NRF have five months to prepare and formulate a damage control I suggest they get hold of a very competent PR agency!
At least Ingrid will be spared the worst fallout, unless the Australian press hound her for a statement.

They do or alternatively lay judges combined with professional judges. But that's only for cases where the defendant has pleaded not guilty and only for cases where the sentence-frame carry an X number of years in prison. Four counts of drugrape plus domestic abuse is more than enough to ensure it will be a trial by either a jury or lay-judges. (Correction: Norway abolished juries in 2017. My info was outdated.)
Marius is fully expected to sit with his defense lawyer every day of the trial. He can AFAIK only be excused if he is seriously ill, physically or mentally.

Wow, he’s finally been charged! It is about time!!! It sounds like the prosecution has done a very thorough job in putting this all together and deciding on charges. Now, with all of these charges will he finally be locked up or does he still get to be free to abuse other women and live the high life while awaiting trial?

What also needs to be analyzed is how Mette-Marit fits into all of this, since she is ultimately his mother. And I'm sure this is a very difficult situation for her.
The Royal Household will have to handle this situation with tweezers and try to somehow protect the image of Crown Prince Haakon, Princess Ingrid Alexandra, and Prince Sverre Magnus.
From now on, the Royal Family should never again appear in public with Marius, whatever the situation.

Today there was over 30 media representatives at the State Prosecutor's press meeting, among them German media. The trial will be a huge media circus!

Marius is not being arrested by the police now. There are no conditions for imprisonment now, said State Prosecutor Sturla Henriksbø.

At Nettavisen's column is written among other things:
Anyone who thought that the police had been harsh, or that the uproar surrounding Marius Borg Høiby had been exaggerated, must think again.
The indictment presented by State Prosecutor Sturla Henriksbø today is simply overwhelming: When the trial comes up, the Crown Princess's eldest son will be charged with a total of 32 counts. This means that the State Prosecutor believes that the police will be able to prove a total of 32 offenses.
The penalty, if the Oslo District Court agrees with the State Prosecutor in the not too distant future, is a full 10 years in prison.
This means that the Kingdom of Norway must prepare for a future where the sitting royal couple has a convicted son in prison. As far as I know, this has never happened before, and could have unforeseen consequences for the monarchy. What they are, is too early to say.
In the short term, it is quite possible that the royal family will receive waves of sympathy. In the longer term, I believe a debate about the future of the monarchy will emerge.

Like most of Europe, Norway has no juries but leaves the whole court process to one or multiple professional judges (+ in some cases additionally two lay judges).

Thank you! With 32 serious charges I just don’t understand why he’s not under house arrest, some sort of rehab facility, somewhere he’s not free to continuing to abuse other women. Haven’t some of these incidents of abuse taken place after it became pubic knowledge that he was under investigation? Where is the concern about recidivism and protecting the public?

Speaking on how it handled here in my country (and Norway seems to have a similar handling on it):

Because no court found him to be a risk to the public or to the case.

That might encounter incomprehension but it how most western justice system work. A court also can't order him to be in a rehab facility before he is convicted and despite the more than overwhelming evidence against him, he considered innocent until conviction.

If I’m not mistaken, that list is only 23. How did they get to 32?

I would love to see him dragged through the humiliation of a trial ... however, it's probably best for him, and his idiot step-father and mother, to bargain a plea deal.

If I’m not mistaken, that list is only 23. How did they get to 32?

On the NRK website it says that the 32 counts include the ones listed, so I guess not all are listed.
What is also listed are several cases (no number) of filming women's genitals without their consent.

I am not sure they have plea deals in Norway. In general that is not as common a practice in Europe as in the US. The state prosecutor seems to expect it to go to trial...

It would be better for them, yes, but I think the damage this will do to them is the CP couple's own fault.

There has not been as much reputational damage yet as there probably would have been in many other monarchies, but I mean today 32 charges, including 4 rape charges, against the future Queen's son were announced live on Norwegian television. One of the rape charges took place at their house! I can't see how it would not damage them now...

I’m very glad things are moving along! My impression of Norway’s justice system and treatment of abuse victims has improved, though my impression of the CP couple is worse than ever.

Reading about the cases is absolutely sickening. Those poor women. Kudos to them for finding the strength to see this through. I hope the public and media treat them well during this whole ordeal.

What a pitiful excuse for a man, this Marius. Even among criminals, he sinks to the lowest rank, preying only on women in desperate, vulnerable circumstances. He never stood up to someone stronger, never pulled off anything clever. He just preyed on women, often SLEEPING women, and hid behind his mother’s name when trouble finally caught up to him. What a waste of a human.

No such thing as a plea bargain in Norway. He'll face the music. - He does have the option to plead guilty to all charges and it - may - lead to a more lenient sentence.
But I doubt very much Marius will plead guilty to anything. And I firmly believe he will appeal, almost regardless of what the sentence is.
