His older two children were born out of wedlock, but became children of a Viscount upon their parent's marriage yet the oldest son (Ben) is now not Viscount Lascelles. Is this because he was born out of wedlock, thus he is not entitled to inherit?

Yes, only the new Earls son born in wedlock will inherit the earldom. Those born before marriage may be allowed courtesy titles as the children of an earl but cannot inherit the peerage or have a place in the line of succession to the throne.
